Welcome to Zizoto! These Terms of Service govern your use of Zizoto and provide information about the Zizoto Service.
2. Acceptance of Terms
By accessing and/or using Zizoto, you are agreeing to these Terms. If you do not agree to these Terms, do not access and/or use Zizoto.
3. Changes to Terms
Zizoto reserves the right to modify the Terms at any time. We will make an effort to communicate any changes to you, but it is ultimately your responsibility to review these Terms periodically. By continuing to use Zizoto, you accept any changes to these Terms.
5. Use of The Service
You may not access or use the Service or create an account for unlawful purposes. Your use of the Service and behavior on the Service must comply with applicable local or national laws or regulations of your country.
6. Account Suspension
Zizoto reserves the right to suspend or terminate your account at its discretion.
7. Content and Rights
By using Zizoto, you understand and agree that any images you generate using the Zizoto platform may be used by Zizoto for any purpose, including but not limited to selling posters, promotional materials, and other marketing or business purposes. While Zizoto reserves these rights, we also encourage and allow our users to freely use the images they create on Zizoto as they please, subject to these Terms of Service and any applicable laws or regulations.
8. Limitation of Liability
Zizoto will not be liable for any damages or losses arising from your use or inability to use the Service or otherwise arising under this agreement.
9. Dispute Resolution
We want to address your concerns without needing a formal legal case. Before filing a claim against Zizoto, you agree to try to resolve the dispute informally.
10. Governing Law and Jurisdiction
These Terms are governed by the laws of the United States of America, without regard to conflict of law principles.
11. End User License Agreement (EULA)
By using Zizoto, you accept and agree to these terms:
Objectionable Content and Abusive Users: There is no tolerance for objectionable content or abusive users. Users are responsible for their conduct and any data, text, files, information, usernames, images, graphics, photos, profiles, and other content or materials they submit, post, or display on Zizoto.
Filtering Objectionable Content: Zizoto reserves the right to monitor all content and to remove any content which it considers in its absolute discretion to be objectionable.
Flagging Objectionable Content: Users can report objectionable content by using the designated reporting mechanism within the app.
Blocking Abusive Users: Users have the ability to block and report abusive users. Abusive behavior will not be tolerated, and users who act abusively will be ejected from Zizoto.
Acting on Reports: Zizoto will try to act on objectionable content reports within a reasonable amount of time by removing the content and ejecting the user who provided the offending content if Zizoto deems the content in Objectionable (see section 12).
Your license to use Zizoto will terminate if you violate these restrictions. Upon termination, you could be held liable for damages as prescribed in U.S. law. Zizoto reserves the right to change these conditions at any time, and you are responsible for regularly reviewing these conditions.
Your continued use of Zizoto constitutes your agreement to all such terms, conditions, and notices.
12. Definition of Objectionable Content
Objectionable content is defined as any content that:
Promotes racism, bigotry, hatred, or physical harm of any kind against any group or individual.
Harasses or advocates harassment of another person.
Exploits people in a sexual or violent manner.
Contains nudity, violence, or offensive subject matter or contains a link to an adult website.
Solicits personal information from anyone under 18.
Publicizes or promotes commercial activities and/or sales without our prior written consent such as contests, sweepstakes, barter, advertising, and pyramid schemes.
Involves the transmission of “junk mail,” “chain letters,” or unsolicited mass mailing, instant messaging, “spimming,” or “spamming”.
Contains any information which we deem to be misleading, false, or inaccurate at the sole discretion of Zizoto.
We reserve the right, in our sole discretion, to reject, refuse to post, or remove any posting by you, or to deny, restrict, suspend, or terminate your access to all or any part of Zizoto at any time, for any reason, with or without prior notice or explanation, and without liability.
13. Restrictions on Use of Zizoto APIs
Your use of Zizoto is strictly limited to the access and functionality provided by the Zizoto application itself. You are expressly prohibited from accessing or using any Zizoto APIs directly, including but not limited to the image generation/morphing APIs, or in any manner that bypasses the intended use and navigation of the app, such as but not limited to web scraping or any other form of unsanctioned data extraction.
Any use of Zizoto APIs outside of the Zizoto app, without explicit written consent from Zizoto, is considered a violation of these Terms of Service. Such violations may result in immediate suspension or termination of your account, at the sole discretion of Zizoto. We reserve the right to pursue legal action in response to unauthorized use of our APIs, and you may be held liable for damages as prescribed in U.S. law.
Please note that this restriction is put in place to protect the integrity of Zizoto and its users, and to ensure the best and safest user experience for everyone. We appreciate your understanding and adherence to this policy.
14. Returns and Cancellations
At Zizoto, we are committed to ensuring our customers are satisfied with the products they purchase. However, due to the nature of our service, we do not accept returns.
If an item arrives damaged or incorrect, please let us know. We will happily issue a refund for the item. To request a refund, please email us at contact_at_zizoto_dot_com with your order details, an image of the damaged item (if applicable), and a description of the issue.
If you need to cancel an order, please email us at contact_at_zizoto_dot_com as soon as possible, providing your order details. While we will make every effort to accommodate your cancellation request, we cannot guarantee that we will be able to cancel orders that have already been processed.
